Terms and Conditions
Akliv ("we", "us", "our" or Akliv is an Indian clothing brand based in Noida Uttar Pradesh specializing in ethnic and contemporary apparel. These Terms and Conditions govern your access to and use of our website www.akliv.com and its affiliated domains mobile applications physical stores and related services collectively referred to as the Platform.
By accessing browsing or placing an order on the Platform you agree to be bound by these Terms along with our Privacy Policy Shipping Policy and Return Exchange and Refund Policy which are incorporated by reference. If you do not agree with any part of these Terms please do not use the Platform.
These Terms constitute a legally binding agreement under the Indian Contract Act 1872 Information Technology Act 2000 Consumer Protection Act 2019 and Consumer Protection E Commerce Rules 2020.
1. Eligibility
You must be at least 18 years of age or have valid parental or legal guardian consent to use the Platform.
You agree to provide accurate complete and current information during account registration and checkout.
You must not use the Platform for any unlawful fraudulent or unauthorized purpose.
2. Account Registration
You may create an account using your email address phone number or social login options such as Google or Facebook.
You are solely responsible for maintaining the confidentiality of your account credentials.
You must notify us immediately at contact@akliv.com of any unauthorized access or use of your account.
We reserve the right to suspend or terminate any account found to be in violation of these Terms.
3. Product Information and Pricing
All product images descriptions sizes and colors are for reference purposes only. Minor variations may occur due to lighting screen settings handcrafting or fabric dye lots.
All prices are listed in Indian Rupees and are inclusive of applicable GST unless stated otherwise.
We reserve the right to correct pricing or typographical errors at any time. If an order is placed at an incorrect price we may cancel the order and issue a full refund.
Promotional offers discount codes and sale pricing are subject to specific conditions including validity period and minimum order value.
4. Order Placement and Acceptance
Placing an order on the Platform constitutes an offer to purchase.
An order confirmation email indicates receipt of your order but does not signify acceptance.
Order acceptance occurs only upon dispatch and issuance of a shipping confirmation.
We reserve the right to refuse or cancel any order due to product unavailability pricing or description errors suspected fraud violation of these Terms or non serviceable delivery locations.
In the event of order cancellation any amount paid will be refunded within 7 to 10 business days to the original payment method.
5. Payment
We accept UPI credit cards debit cards net banking wallets EMI and Cash on Delivery subject to availability.
COD is available for orders up to ₹5000 and carries an additional fee of ₹299.
Refusal of a COD order at delivery will result in cancellation and a ₹299 restocking fee.
All payments are processed through secure third party payment gateways.
By placing an order you authorize us to charge the total payable amount including applicable fees.
6. Shipping and Delivery
Shipping timelines charges and courier partners are detailed in our Shipping Policy.
Risk of loss and ownership of the product pass to you upon successful delivery to the provided address.
Delivery delays caused by events beyond our control including natural disasters strikes or government restrictions are not our liability.
7. Returns Refunds and Exchanges
Returns exchanges and refunds are governed by our Return Exchange and Refund Policy.
Certain items including innerwear customized or made to order products sale items and free gifts are non returnable.
Eligible returns must be initiated within the specified timeline with original tags packaging and invoice intact.
8. Intellectual Property
All content available on the Platform including logos designs text images graphics and videos is the intellectual property of Akliv or its licensors.
You may not reproduce copy distribute modify or create derivative works without prior written consent.
By submitting reviews photos or other content you grant Akliv a royalty free perpetual and irrevocable license to use such content for marketing and promotional purposes.
9. User Conduct
You agree not to use the Platform in any manner that could damage disable or impair its functionality.
You must not use automated tools bots or scrapers to access the Platform.
You must not post or transmit defamatory obscene abusive or unlawful content.
You must not impersonate any individual or entity.
10. Limitation of Liability
Products are provided on an as is basis except as expressly required by applicable law.
To the maximum extent permitted by law Akliv shall not be liable for indirect incidental or consequential damages delays in delivery or losses arising from incorrect information provided by you.
Our total liability shall not exceed the total value of the order giving rise to the claim.
11. Indemnity
You agree to indemnify and hold harmless Akliv its directors officers employees and partners from any claims losses liabilities or expenses arising from your breach of these Terms misuse of the Platform or violation of third party rights.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts located in Noida Uttar Pradesh.
Consumers may also approach the appropriate District Consumer Disputes Redressal Commission or the National Consumer Helpline at 1800 11 4000.
13. Force Majeure
We shall not be held liable for failure or delay in performance due to events beyond our reasonable control including but not limited to war riots pandemics floods strikes or governmental actions.
14. Modifications to Terms
We reserve the right to update or modify these Terms at any time.
Revised Terms will be posted on the Platform with an updated effective date.
Continued use of the Platform after changes constitutes acceptance of the revised Terms.
15. Termination
We may suspend or terminate your access to the Platform without prior notice for violation of these Terms.
